Terms of Service

Domain Prospector is an AI-powered platform that aggregates data on expired and auction-listed domain names and provides analysis, scoring, alerts, and investment intelligence to subscribers. We do not sell, register, or broker domain names ourselves. All domain transactions occur on third-party platforms such as GoDaddy Auctions.

You must be at least 18 years old and capable of forming a legally binding contract to use the Service. By using the Service you represent that you meet these requirements. The Service is not directed at children under 13.

• You must provide accurate registration information and keep it up to date.
• You are responsible for maintaining the security of your password and account.
• You must notify us immediately at legal@domainprospector.net if you suspect unauthorised access.
• One person or legal entity may not maintain more than one free account.

The Service operates on a credit system. Credits are consumed when you use premium features including domain detail views, AI analysis, enrichment, and exports.

4.1 Subscriptions

Paid subscription plans (Starter, Pro) are billed monthly via Stripe. Subscription fees are charged at the start of each billing period and are non-refundable except as required by applicable law. You may cancel at any time; cancellation takes effect at the end of the current billing period.

4.2 Credit purchases

Credit top-ups are one-time purchases processed via Stripe. Credits do not expire and have no cash value. Credits are non-refundable once consumed. Unused credits are forfeited if your account is terminated for a breach of these Terms.

4.3 Price changes

We may change subscription pricing on 30 days' written notice. Continued use after the notice period constitutes acceptance of the new pricing.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Scrape, crawl, or programmatically extract data from the Service beyond what is available through our API.
• Resell, sublicense, or commercially redistribute data obtained from the Service without our prior written consent.
• Attempt to reverse-engineer, decompile, or circumvent any security measure.
• Upload or transmit malicious code, spam, or any content that infringes third-party rights.
• Create fake accounts, manipulate credits, or abuse promotional offers.
• Interfere with or disrupt the integrity or performance of the Service.

Domain analysis, scores, valuations, and investment suggestions are generated by artificial intelligence and are provided for informational purposes only. They do not constitute financial, legal, or investment advice. AI outputs may contain errors or inaccuracies. You are solely responsible for any decisions you make based on information obtained through the Service. We strongly recommend independent due diligence before acquiring any domain name.

The Service incorporates data from third-party sources including GoDaddy, Ahrefs, and SEMrush. We do not guarantee the accuracy, completeness, or timeliness of third-party data. Links to third-party platforms are provided for convenience; we are not responsible for the content or practices of those platforms.

The Service, including its software, design, trademarks, and original content, is owned by or licensed to us and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your own internal business purposes. Nothing in these Terms transfers ownership of any intellectual property to you.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) USD 100.

You agree to defend, indemnify, and hold harmless Domain Prospector and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service or violation of these Terms.

We may suspend or terminate your account at any time if you breach these Terms, with or without notice. You may close your account at any time via account settings. On termination, your right to access the Service ceases immediately. Sections 6, 8, 10, 11, 12, and 14 survive termination.

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms shall first be referred to good-faith negotiation. If unresolved after 30 days, disputes shall be submitted to the jurisdiction of the South African courts. Nothing in this clause limits your rights under mandatory consumer protection laws in your country of residence.

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a prominent notice in the Service. Continued use of the Service after the effective date of the updated Terms constitutes acceptance.
